Barry Grimshaw (Inspector) had advised
that he has drawn up a rough timetable/running order due to
the anticipated length of the inquiry, the fact that not all
parties have an interest in all five Orders to be considered
and the representations I have received regarding
difficulties being experienced by some parties in being
represented throughout the whole inquiry.
He advises that he has considered
dealing with the five Orders sequentially so as to enable
those parties with no interests in some of the Orders to
minimise their need to attend. However, there are features
common to all the Orders and inevitably much evidence would
be repetitious if this approach were adopted. He has decided
to therefore deal with all five Orders simultaneously as far
as is possible. He intends to adhere as far as possible to
the accepted order of procedure for inquiries such as this,
although he will endeavour to accommodate specific
reasonable requests of parties to vary this.
The preliminary timetable is intended
to assist parties but should be treated very much as a draft
and is highly likely to need to be adjusted as the inquiry
progresses
In general terms, the inquiry will be
open from 10:00 to 17:00 each day (except Friday 10 December
when it will adjourn at 15:00) with roughly 1 hour (13:00 –
14:00) for lunch. Mr Grimshaw will however be prepared to
consider requests for earlier starts/later finishes if it
seems necessary.

Public Consultation
/ Inquiry on
Rights of Way at
Ipswich Docks / Waterfront
Tuesday 7th - Friday 10th
and
Wednesday 15th
and
possibly

December
|
Public
Inquiry
Following an investigation into a
package of rights of way claims around the Docks area
submitted by Suffolk Rights of way Ltd, a detailed report
was presented to the Rights of Way Committee in March 2009.
The Committee resolved to make 5 orders which were made on
14 July 2009 and several objections subsequently received.
Following submission of the orders and
objections to the Planning Inspectorate a 6 day public
inquiry has been arranged, commencing on Tuesday 7 December
and running until Friday 10 December, reconvening on Wed 15
December and again on Tues 21 December if necessary.
Suffolk County Council (SCC) will be
supporting the 5 orders it has made (3 restricted byways and
two double cul-de-sac footpaths). There are seven formal
objectors, including Associated British Ports, Neptune
Marina, Anglo Nordern and Suffolk Rights of Way Ltd (the
original claimants).
The Inquiry will be held at the
Conference Room, IP City Centre, Bath Street, Ipswich and
SCC's external advocate is Gordon Nardell QC.
The Inspector conducting the Inquiry
is Barney Grimshaw. The purpose of the Inquiry is to enable
Mr Grimshaw to hear and consider all of the evidence for and
against the published orders. He will subsequently issue a
decision letter advising whether he has confirmed them as
made, confirm them with modifications or declined to confirm
them. It is important to note that the legislation does not
allow for any other evidence, such as desirability or
environmental grounds, to be considered at the Inquiry,
which will deal exclusively with the documentary and user
evidence in support and against the routes being added to
the Ipswich Definitive Map as public rights of way.
Anyone who wishes to give evidence at
the PI will have to comply with some fairly rigid
timescales. Anyone who has made an objection or
representation or who wishes to give evidence must submit a
Statement of Case to the Planning Inspectorate by 1 October.
The Inspectorate will circulate that. Those wishing to give
evidence must then ensure that their proofs of evidence are
with the Inspectorate by 9 November. The purpose of this
timescale (which is in accordance with the relevant
Statutory Instrument) is to ensure that there are no
surprises, that everyone knows what is being asserted, and
that things run as efficiently as possible. An individual
member of the public who is called to give evidence (eg
evidence of use) does not have to notify the Inspectorate;
it is for the person calling the witness to do that. It is
up to the Inspector to decide whether to allow people who
turn up on the day and wish to give evidence to be able do
so, where they have not given due notice.
The contact details are: The Planning
Inspectorate, Room 4/05, Kite Wing, Temple Quay House, 2 The
Square, Temple Quay, Bristol, BS1 6PN; tel 0117 372 6353
(Jean McEntee); email jean.mcentee@pins.gsi.gov.uk. Their
reference is FPS/V3500/7/303. It would probably be a good
idea for any prospective participant to contact the
Inspectorate informally as soon as possible and to clarify
whether he wants to give evidence on proposed RBs 36, 37 or
38, or proposed FPs 39 or 40.

Residents
angry over
junction work
[Duke Street / Back Hamlet / Fore
Hamlet / Fore Street / Neptune Square] |
IPSWICH: Residents’ anger over changes
to a town centre junction threatened to boil over at a
heated meeting with county council staff.
About 70 people turned out to the
meeting last night in the University Campus Suffolk building
on the Waterfront to discuss the work currently underway at
the Duke Street junction with Fore Hamlet.
County council cabinet member Guy
McGregor and engineer David Watson were there to explain the
changes to the road.
Many residents felt that the county
had “jumped the gun” by going ahead with the work before all
the orders changing the traffic flows along Duke Street and
Back Hamlet had been agreed.

Vehicles to be banned from Waterfront?
|
Vehicles could be banned from
Waterfront
[extract from Evening Star
10/08/10]
Opportunities to pedestrianise the
Waterfront
area of Ipswich are under consideration. Under
proposals to update the definitive map for the town, three
new restricted byways could be planned for the Waterfront
development, meaning unauthorised vehicles would not be
permitted to drive through the area. Private vehicles used
for the area’s businesses are not expected to be included in
the ban.
If approved, the plans would see
restrictions in place from Foundry Lane along the Waterfront
to Ship Launch Road via Wherry Lane. Two further
restrictions would be in place from Foundry Lane over the
swing bridge to Ship Launch Road and from the junction of
Dock Street to the end of Bath Street. Andrew Woodin,
countryside access leader for Suffolk County Council, said:
“Rights of ways come in various forms and sizes, from
footpaths to byways. After viewing the evidence for the
Waterfront area of Ipswich, we have proposed five public
rights of way.
“Two of these are public footpaths –
showing a right of way to pedestrians – and the other three
are called restricted byways which gives rights to walkers,
cyclists, horses and carriages. It does not include public
motorised vehicles.”
If confirmed as restricted byways,
there will no access for the public in vehicles, but private
vehicular rights will be unaffected. This will create an
opportunity for a car free pedestrianised area with more
activity taking place.

New Hotel for Ipswich Waterfront |
New Hotel For Ipswich
Waterfront
[extract from Evening Star
07/08/10]
IPSWICH: A new 87-room hotel could be built near the town’s
Waterfront after Travelodge submitted a new application.
It wants to build the hotel in Duke Street, next to the Loch
Fyne restaurant on the site of the former Kenning’s car hire
centre. The application has been received by the borough’s
planning department and is expected to be discussed by
councillors early in the autumn.
If it is given the go-ahead work on the project is likely to
start early next year. A spokesman for Travelodge said:
“After looking for a new site in Ipswich for over five
years, we are extremely pleased to have identified this
prominent site.
“Travelodge is committed to investing in Ipswich and subject
to planning the contemporary hotel will have a Bar Café and
parking facilities with the view to be on site in early
2011.
“The hotel will have fantastic views of the harbour due to
its prominent location on Duke Street and will offer rooms
from £19 as well as creating jobs in the town.
“We want to give travellers every reason to visit Ipswich
and stay longer – we see increasing the availability of low
cost accommodation in the area as central to achieving this
objective.”
